TERMS AND CONDITIONS FOR PERFORMING PROCEDURES AT POWAB CLINIC

These Terms and Conditions, hereinafter referred to as the “Regulations,” in accordance with Article 384 of the Civil Code, define the general terms of the agreement under which the Client receives a service in the form of a procedure or purchases goods, the rights and obligations of the Parties to such a transaction, including obligations regarding personal data protection, as well as the principles of liability of the Parties. The Regulations are available via the website www.powabclinic.pl, on the POWAB CLINIC page accessible through the social networking portal FB, and at the POWAB CLINIC facility.

Definitions:

Price List of Services – the current price list of services and goods offered by POWAB CLINIC, expressed in Polish zlotys; the amounts listed in the price list are gross amounts. The price list is available on the website www.powabclinic.pl, on the POWAB CLINIC page available on the platforms booksy.com and moment.pl, and at the POWAB CLINIC facility.
Client – a natural person with full or limited legal capacity, a legal person, or an organizational unit with legal capacity but without legal personality, using the services offered by POWAB CLINIC. POWAB CLINIC – the POWAB CLINIC facility located in Warsaw, at ul. Zwycięzców 28, unit U.13, 03-938 Warsaw.
Agreement – the agreement concluded between the Client and POWAB CLINIC. The decision to use the services of POWAB CLINIC, making a prepayment, and booking an appointment constitute the conclusion of a civil law agreement for the provision of services and are equivalent to accepting these Regulations.
Procedure – within the meaning of these Regulations, the term “procedure” refers to an aesthetic medicine procedure, cosmetic procedure, procedure using specialized Hi-Tech equipment, or laser hair removal procedure.

§1 General Principles

1. Utilizing the services of POWAB CLINIC is possible after the Client is qualified for the procedure by the Clinic’s professional staff, completing the necessary forms, including the Client Card, Client Health Declaration, Consent for the procedure, making payment for the services, and entering the appropriate record into the IT system by a POWAB CLINIC employee. 2. The selected service can be performed at the POWAB CLINIC facility, provided that the chosen procedure is included in the current offer of POWAB CLINIC.
POWAB CLINIC reserves the right to make changes to the offer. The catalog of currently available procedures at individual facilities is available on the website www.powabclinic.pl, on the POWAB CLINIC page accessible through the social networking portal FB, and at the POWAB CLINIC facility. 3. By entering into an agreement with POWAB CLINIC, the Client simultaneously declares that they have read these Regulations and have no objections to them.

§2 Basic Principles of Performing Procedures

1. Consent for a procedure can be given by an adult Client with full or limited legal capacity.
2. Consent for a procedure can also be given by a minor Client who has reached the age of 16, for whom the service is to be performed; however, if the patient is under 18 years of age, consent for the procedure must also be given by their legal representative.
3. Consent for performing a procedure on a Client under 16 years of age can only be given in writing by the Client’s legal representative, using the appropriate POWAB CLINIC form.
4. POWAB CLINIC reserves the right not to perform a service for a Client whose condition indicates alcohol consumption or the use of other intoxicants.
5. Procedures are performed exclusively during the operating hours of the POWAB CLINIC facility. The facility’s operating hours are available on the website www.powabclinic.pl, on the POWAB CLINIC page accessible through the social networking portal FB, and at the POWAB CLINIC facility. 6. POWAB CLINIC reserves the right to change the facility’s operating hours. The change may involve temporary closure of the facility, as well as shortening or extending its operating hours. The use of some or all areas of the facility may be temporarily suspended due to the sudden need for repairs, maintenance, or other necessary work.
7. Procedures are performed according to the price list established by POWAB CLINIC, valid on the day the service is performed, unless the provisions of other regulations state otherwise.
8. All prices listed in the price list and on the website www.powabclinic.pl are gross prices and are expressed in Polish zlotys.
9. The prices of aesthetic medicine procedures are indicative and will be specified during the Client’s qualification for the procedure.
10. Purchased procedures or procedure packages are non-refundable, subject to §8 point 1. 11. Purchased procedures or procedure packages must be used within 6 (six) months from the date of purchase.
12. “Until effective” packages can be used within 2 years from the date of service purchase.
13. The maximum number of procedures for a given area in the “until effective” package is 11 procedures.
14. After the period specified in point 12 above, purchased procedures or procedure packages expire and cannot be used after this period. 15. The date specified in point 12 above is also the expiration date of the agreement concluded between the Client and POWAB CLINIC. 16. Discounts, reductions, promotions, and vouchers granted to the Client are not cumulative.
17. In the case where the service provided by POWAB CLINIC is a health service to which the provisions of the Act of April 15, 2011, on medical activity (Journal of Laws of 2011, No. 112, item 654) apply, the provisions of the indicated Act apply regarding consent for the procedure.



§3 Exchange of Procedures

1. It is permissible to exchange a purchased procedure or procedure package for another procedure or procedures offered by POWAB CLINIC only for documented health reasons of the Client or due to equipment failure used for the procedure(s). 2. The exchange of a purchased procedure or procedure package does not extend their validity period as specified in §2 point 12 of these Regulations, except as provided in point 4 below. 3. In the event of equipment failure for which the procedure or procedure package was purchased, POWAB CLINIC will indicate other equipment with similar or better technical parameters. 4. If the equipment exchange mentioned in point 3 above is impossible or cannot occur for other justified reasons, POWAB CLINIC allows the possibility of extending the validity of the purchased procedure or procedure package by the number of days during which the procedure on the purchased equipment was impossible due to technical reasons. 5. The number and type of procedures to which previously purchased services will be exchanged depend on the amount paid or the remaining amount in the Client’s account for unused services from the executed package. 6. The value of services to which the procedures subject to exchange will be converted is calculated according to the POWAB CLINIC price list valid on the day of the service exchange and cannot exceed the amount mentioned in point 5 powyżej. 7. Ewentualna kwota pozostała na koncie Klienta, stanowiąca różnicę pomiędzy wartością zamienianych zabiegów a wartością usług na które zostały one zamienione, nie podlega
zwrotowi.
8. W przypadku zaistnienia sytuacji o której mowa w ust. 7 powyżej, pozostała na koncie Klienta kwota, zostanie odliczona od wartości kolejnego, opłaconego przez Klienta rachunku, z zastrzeżeniem terminu o którym mowa w §2 ust. 12 niniejszego Regulaminu.

§4 Booking and Performing Procedures

1. To book an appointment for a selected procedure or consultation, one must personally visit POWAB CLINIC or contact the facility by phone/email where the service is to be performed. 2. Aesthetic medicine procedures are performed only after prior booking made by the Client. 3. POWAB CLINIC reserves the right not to perform a Hi-Tech, cosmetology, or Spa procedure without prior Client booking, due to, among other things, technical or personnel reasons. 4. A Client who has booked an appointment for a consultation or first/single procedure is required to arrive at the facility where the service is to be performed no later than 10 minutes before the agreed time to complete all formalities. 5. A Client who has booked a subsequent procedure from a series/package is required to arrive at the facility where the service is to be performed no later than 10 (ten) minutes before the agreed time to prepare appropriately for the planned procedure.
6. In case of the Client’s delay for the scheduled appointment, the delay time is deducted from the time allocated for the procedure.
7. POWAB CLINIC reserves the right to refuse to perform the procedure and retain the full prepaid amount if the Client’s delay exceeds 15 (fifteen) minutes.
8. A scheduled procedure can be canceled without any consequences, including financial ones, no later than 24 (twenty-four) hours before the scheduled appointment. The Client is not allowed to change the scheduled procedure to another without prior consent from POWAB CLINIC.
9. POWAB CLINIC reserves the right to charge the Client for the service according to the rates as if it were performed if the procedure is canceled by the Client less than 24 (twenty-four) hours before the scheduled time or if the Client does not show up for the scheduled visit without prior cancellation.
10. A service is considered completed in the situations described in points 9 and 10 above, meaning the procedure is deducted from the package if the service is performed in a series, and the Client’s prepayment is forfeited to POWAB CLINIC.
11. If a Client using the “until effective” package fails to keep the procedure appointment twice, which must occur every 5-7 weeks, the “until effective” package becomes a “6 procedures” package.
12. If the interval between package procedures, including the “until effective” laser hair removal package, exceeds 4 months, i.e., 4 months or more, the package becomes invalid.
13. By proceeding with the procedure, the Client automatically declares that:
a) They are aware of the purpose and possible effects of the procedure.
b) All issues related directly or indirectly to the preparation and application of the selected procedure have been explained to them, which they fully understand.
c) They are aware of and understand all contraindications, possible side effects, and effects of the procedure.
d) They have been informed about the characteristics of the selected procedures, understand that they are actions of due diligence, and are aware that the procedures do not guarantee certain and visible results.
e) They will not demand a refund for the procedure if the selected procedure does not bring the intended result.
f) Before using POWAB CLINIC services, they considered their health condition and will not undergo the procedure if, due to their health condition, the procedure could negatively affect their.

. www.powabclinic.pl 5. Klient ponosi odpowiedzialność finansową za ewentualne szkody wyrządzone na terenie Kliniki POWAB CLINIC z jego winy. 6. Palenie tytoniu, picie alkoholu i używanie jakichkolwiek środków odurzających na terenie Kliniki POWAB CLINIC jest zabronione. 7. W przypadku niestosownego zachowania pacjenta na terenie POWAB CLINIC lub rażącego naruszenia porządku czy przebiegu procesu udzielania świadczeń, personel ma prawo odmówić lub przerwać świadczenie usługi i poprosić o niezwłoczne opuszczenie terenu placówki. W takiej sytuacji POWAB CLINIC ma prawo do natychmiastowego wypowiedzenia umowy o świadczenie usług i zatrzymania opłaty za usługę w pełnej wysokości, jako rekompensatę poniesionych strat i odszkodowanie z tytułu utraconych korzyści. 8. POWAB CLINIC zastrzega sobie prawo do dokonania modyfikacji postanowień Regulaminu, pod
warunkiem, że wprowadzone zmiany nie naruszą praw nabytych przez Klientów w trakcie
trwania oferty. Ewentualne zmiany w Regulaminie będą każdorazowo ogłaszane na stronie
internetowej www.powabclinic.pl
9. W sprawach nieuregulowanych niniejszym Regulaminem zastosowanie mają odpowiednie
przepisy kodeksu cywilnego. Wszelkie spory wynikłe z tytułu wykonania
